This document is an electronic record in terms of the Information Technology Act, 2000 and rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of EatForSure on Google Play Store, including the related mobile application (hereinafter referred to as the 'Platform').

The Platform is operated by EatForSure (hereinafter referred to as 'Platform Owner', 'we', 'us', 'our').

Your use of the Platform and its services and tools is governed by these terms and conditions ("Terms of Use"), together with our Privacy Policy, Refund & Cancellation Policy, Return Policy and Shipping Policy, which are incorporated by reference. If you transact on the Platform, you are also subject to the policies applicable to that transaction.

1. Description of Services

EatForSure is a mobile application that enables users to:

• Food ordering: Browse restaurants/outlets, place orders for food and beverages, and get them delivered to a chosen address within the service area.
• FMCG / Grocery (Product) ordering: Browse stores/outlets, add FMCG and grocery products to cart, place product orders, and get them delivered.
• Pick and Drop services: Create pick-and-drop orders (e.g. parcel or item pickup from a designated store/location and delivery to you), subject to availability in your delivery zone.

Delivery is fulfilled by our delivery personnel or partners within designated delivery zones. Payment for orders is processed through supported payment methods (including UPI via third-party payment providers). Offers, coupons and discounts may be available from time to time and are subject to their respective terms.

2. Eligibility and Account

You must be at least 18 years of age and capable of entering into a legally binding contract to use the Platform. By using the Platform, you represent that you meet these requirements. You agree to provide true, accurate and complete information during registration and to keep it updated. You are responsible for all activity that occurs through your account and for maintaining the confidentiality of your login credentials. Notify us immediately if you suspect unauthorized use of your account.

3. General Terms of Use

The use of the Platform and/or availing of our Services is subject to the following:

1. You will use the Platform only for lawful purposes and in accordance with these Terms and applicable Indian and local laws. You will not use the Platform or Services for any unlawful, fraudulent or prohibited purpose.
2. We do not warrant the accuracy, timeliness, completeness or suitability of any information, menus, product descriptions, prices or availability on the Platform. Listings are provided by restaurants, stores and partners. You acknowledge that there may be inaccuracies or errors, and we exclude liability for the same to the fullest extent permitted by law.
3. Your use of the Platform and Services is at your own risk. You are responsible for ensuring that the Services meet your requirements. We are not liable for any loss or inconvenience arising from your use of the Platform or reliance on any content thereon.
4. All content on the Platform (including design, layout, graphics, logos and text) is proprietary to us or our licensors. You have no right to claim any intellectual property in such content. You may not copy, modify, distribute or use our content without our prior written consent.
5. You agree to pay all charges associated with your orders (food, product or pick-and-drop), including delivery fees, taxes and any other applicable charges, in accordance with the payment method you select and the pricing displayed at checkout.
6. Upon placing an order, you enter into a binding contract with the Platform Owner for the provision of the selected Service. Cancellation and refund are governed by our Refund & Cancellation Policy.
7. The Platform or Services may contain links to third-party websites (e.g. payment gateways). Your use of such links is subject to the terms and policies of those third parties. We are not responsible for their content or practices.
8. Unauthorized use of the Platform or Services may result in suspension or termination of your account and/or action under these Terms or applicable law.

4. Orders, Delivery and Service Areas

Orders are subject to availability and serviceability in your delivery zone. We do not guarantee delivery times; estimates are indicative. Delivery personnel may contact you for verification or delivery instructions. You are responsible for providing a correct and accessible delivery address and for being available to receive the order (or for authorising someone to receive it) as per your instructions. Risk in food, products or items passes to you upon delivery. For pick-and-drop orders, you are responsible for ensuring that the item description and pickup details are accurate.

5. Payments

Payments are processed through third-party payment providers (e.g. UPI/payment aggregators). By using a payment method on the Platform, you agree to the terms of the relevant provider. We do not store your full card or bank details. Refunds, if applicable, will be processed as per our Refund & Cancellation Policy and the provider's timelines.

6. Offers and Coupons

Offers, coupons and discounts are subject to their specific terms and conditions (including validity period, minimum order value and eligible items). We reserve the right to modify, withdraw or limit any offer without prior notice. Abuse or misuse of offers may lead to cancellation of the order or action against your account.

7. Indemnity

You shall indemnify and hold harmless the Platform Owner, its affiliates and their respective officers, directors, agents and employees from any claim, demand, loss, damage or expense (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms, our Privacy Policy or other applicable policies; (b) your use or misuse of the Platform or Services; (c) your violation of any law or third-party rights; or (d) any dispute between you and a restaurant, store, delivery partner or other third party in relation to an order or the Services.

8. Limitation of Liability

To the maximum extent permitted by law, we (and our affiliates, partners and delivery personnel) shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profit, data or goodwill, arising from your use of the Platform or Services. Our total liability for any claim arising from or related to these Terms or the Services shall not exceed the amount you paid for the order giving rise to the claim. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence or for fraud.

9. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemic, government action, strikes, natural disasters, or failure of third-party services (including payment or delivery partners).

10. Governing Law and Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them (including their enforceability) shall be governed by and construed in accordance with the laws of India. The courts at Jhalawar, Rajasthan shall have exclusive jurisdiction over any such disputes.

11. Contact and Communications

All concerns or communications relating to these Terms must be sent to us using the contact information provided on this Platform (including the email address stated in the footer and in our policies).

12. Changes to Terms

We may modify these Terms at any time. The updated version will be posted on the Platform with a revised "Last Updated" date. Your continued use of the Platform after such changes constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
